CJM denies bail of two in rape case

Jammu, Sept 24: CJM Reasi Kamlesh Pandita today rejected the bail application of Rakesh Kumar @ Rakeshu S/O Sit Ram and Pardeep Kumar @ Aashu S/o Gopal Krishan both residents of Pagha Jaranu Tehsil and District Reasi who were involved in a rape case.
According to the police case that that the accused persons have been arrested in case FIR No. 120/2016 for the commission of offences under sections 376/452/323/109/34 RPC. Police report further reveals that on 5.08.2016 the complainant lodged a written report with the concerned police station that the accused persons having enmity with her husband regarding the land dispute used to harass and molest her regarding which her husband requested the accused not to repeat the same. It has been further averred in the complaint that on 4.08.2016 the accused persons who filed the instant bail application, forcibly entered to her bed room in the dead of night while she was sleeping with her children and door of the room was not locked.
The accused persons with guiltyintention started beating her with fists and blows. The accused Ashu shut her month and caught hold of her while another accused person Rakeshu untied the string of her trouser and committed rape on her and the accused persons thereafter alongwith two persons who were sitting outside the house ran away after threatening her of life.
CJM Reasi Kamlesh Pandita after hearing CPO DP Singh for the state whereas Adv VK Sharma appearing for the accused persons observed that Rape is the crime against one's mind, psyche and reputation, it leaves permanent scar on the life of the victim and it becomes horrendous for the victim of rape to lead a dignified and well respected life in the society. It is very sad that now a days, we see marked increase in the rape instances and ravenous maniacs are not sparing even the girls of tender age and the courts in such offences have to take a call and exercise jurisdiction in such a way, which is appreciated by the civil society at large and dismissed the bail applications.
