Jammu, Jul 13: A “Jail Bird Child” Mobin was lodged at Distt Jail Amphalla, Jammu for no fault. Shahnaz (mother) gave birth to female baby in jail. She inadvertently came from PoK to Indian side and was sentenced to Jail by Sub-Judge Nowshera and lodged at Poonch jail.
She was raped by the then Jail warder but she conceived.
As soon as it was noticed by the then Director General Prison she was shifted to Distt Jail Jammu and she gave birth to female child (Mobin). She remained in jail till matter came into the notice of Mr. A.K. Sawhney Advocate.
Mr. A.K. Sawhney Advocate with his son Mr. Aseem Sawhney (presently Addl. Advocate General J&K High Court) visited Distt Jail and met both mother and child.
By the first reaction Mr. Sawhney Advocate reacted to child “is baby child a jail Bird” What for she is kept in jail inside iron rod doors, what crime she committed?
The writ petition was filed for release of both being under illegal confinement as the sentence of 1 year was served and six years were above. The fact was horrifying. The PIL was allowed and both were released. There was no shelter, home or anyone to take care after her release from jail.
Mr. A.K. Sawhney Advocate and his family gave shelter to both mother and daughter at their residence at main road Mohalla Ustad, Jammu which was nearby jail. She use to recite 5 times Namaz, the child was admitted to a Public School. Ultimately the dispute between countries was about “Nationalism” of female child. Pakistan termed that child is Indian and they can’t accept her after deportation to Pakistan.
Mr. A.K. Sawhney Advocate persuaded to “National” Human Rights of Pakistan to play a humanitarian role to solve as such situation can’t before seen and anticipated therefore, No law could be framed. Now a situation had came where a problem needs redressal. Ultimately Mr. A.K. Sawhney Advocate succeeded through the diplomatic channels and both mother and daughter were deported to Pakistan but it was a very painful to get separated from a child Mobin because she was a family member of “Sawhney family by the time”.
Human Rights Commission of Pakistan appreciated the role played by Mr. A.K. Sawhney Advocate and entire family as an outstanding humanitarian act they intended to do something more to honour Mr. A.K. Sawhney Advocate but since the relations between two countries are like hide and seek therefore reluctance was shown.
Now the producer Siddarth Malhotra has picturised the said story in a very nice way. The picture is named as “KAFIR” but to Mr. A.K. Sawhney Advocate it is just to remember the family member which was lost at one time.
The picture finds Famous star Diya Mirza playing role of Shahnaz and Mohit Raina playing role of A K Sawhney. Dishita Jain is playing role of Mobin and the series is being shown on ZEE5.
