‘Records not traceable’, ACR tells HC; DB seeks entire file from Financial Commissioner's court

JAMMU, Feb 15: The Jammu and Kashmir and Ladakh High Court has sought requisition of the entire record from the court of the Financial Commissioner (Revenue), Jammu, after the Assistant Commissioner (Revenue), UT of J&K, submitted that the relevant case records were "not traceable" despite repeated efforts.
A Division Bench comprising Chief Justice Arun Palli and Justice Rajnesh Oswal was hearing LPA No. 176/2024 in OWP No. 606/2004, titled Pritam Singh and others vs Financial Commissioner (Revenue), Jammu and others.
The court noted that on February 5, it had already expressed displeasure over non-production of records and had made it clear that if compliance was not ensured, the Assistant Commissioner (Revenue), Jammu, would have to remain present.
"Despite repeated orders, the necessary records… have not been produced," the Bench had observed in its earlier order, while continuing the interim direction passed on August 28, 2024.
On Thursday, the Assistant Commissioner (Revenue) appeared before the court and submitted that "despite all possible efforts, the records are not traceable."
He sought another opportunity to locate or reconstruct the missing record.
Granting time, the Division Bench adjourned the matter to March 5, 2026, but directed the Registry to immediately requisition the entire record from the court of the Financial Commissioner (Revenue), Jammu.
"Meanwhile, Office to requisition the entire records from the Court of Financial Commissioner (Revenue) Jammu," the Bench ordered.
The case will now come up for further hearing on the next date.
