SRINAGAR, Oct 14: The Central Administrative Tribunal (CAT), Srinagar Bench, has rejected the plea for regularisation of services filed by a group of rural sanitation motivators in Jammu and Kashmir but directed the authorities to release their legitimately earned unpaid wages within four weeks.
A Bench comprising Member (Judicial) M.S. Latif and Member (Administrative) Prasant Kumar passed the order on October 12 while disposing of T.A. No. 1855 of 2021, which originated as a writ petition before the Jammu and Kashmir High Court in 2011.
The case was filed by the All J&K Motivators Association Srinagar, through its president Nissar Ahmad Tralli, along with 10 other applicants, who had sought regularisation of their services as Key Motivators and Motivators in the Rural Sanitation Department, besides payment of pending wages.
The tribunal observed that the applicants had not been engaged through a regular recruitment process and that the scheme under which they were appointed had been discontinued. It held that the material on record and the applicable legal principles did not support their claim for regularisation.
However, regarding the unpaid wages, the tribunal noted that the records did not establish that the applicants had received all their legitimately earned dues for the periods they had worked.
"Accordingly, it is provided that the legitimately earned wages, for the period the petitioners have worked, shall be released and paid by the respondents to the petitioners at the earliest, preferably within a period of 04 (four) weeks," the order stated.
The tribunal further directed the respondents to submit a compliance report within two weeks thereafter.
The applicants were represented by advocate Nisar Ahmad Bhat, while the respondents were represented by Additional Advocate General Satinder Singh.
The tribunal ordered no costs and disposed of the case along with all connected miscellaneous applications.
